An absconding notice is a formal show-cause letter to an employee who has stopped reporting to work without communication. Indian labour jurisprudence requires the employer to give the employee a real chance to explain before treating the absence as abandonment of service, so the sequence and delivery proof matter more than the wording.

Absconding Notice / Show-Cause Letter Format

An absconding notice is a formal show-cause letter to an employee who has stopped reporting to work without communication. Indian labour jurisprudence requires the employer to give the employee a real chance to explain before treating the absence as abandonment of service, so the sequence and delivery proof matter more than the wording.

What a Absconding Notice Format must include

  • Dates of unauthorised absence, stated precisely
  • Reference to earlier attempts to reach the employee (calls, email, prior letter)
  • A clear direction to report to duty or explain in writing within a stated period (7 days is standard)
  • The consequence, stated plainly: absence will be treated as abandonment of service and processed accordingly
  • Despatch by registered post/speed post to the last known address AND email, with proof retained
  • Authorised signatory with designation

Drafting tips

  • Send two notices, roughly 7 to 10 days apart, before concluding abandonment. Tribunals consistently side with employees where the employer moved straight to termination after one letter.
  • Post to the last known address with proof of despatch AND email. If the letter returns undelivered, keep the returned envelope unopened; it is your evidence of attempted service.
  • Do not mark the employee "terminated for misconduct" in records if you processed it as abandonment; pick one route and keep the paperwork consistent, including in the relieving communication and F&F.
  • Process the full and final settlement even for an absconder: earned leave encashment and any accrued dues remain payable, netted against notice pay recovery. Withholding the entire F&F invites a wage claim.

FAQs

How many days of absence counts as absconding in India?

No statute fixes a number. Company policy usually treats 3 or more consecutive days of unauthorised, uncommunicated absence as potential abandonment, which triggers the notice process. What makes it legally safe is not the day count but the documented sequence: attempts to contact, two show-cause notices with reasonable response windows, and only then removal from rolls.

Can we withhold the full and final settlement of an absconding employee?

You can recover notice pay as per the contract and the value of unreturned company property, but accrued dues like earned salary and leave encashment remain payable. Under the Code on Wages the F&F clock is 2 working days from the last working day; for abandonment cases, settle promptly once the removal from rolls is processed and keep the computation on record.

Should absconding be reported in background verification?

If a future employer runs a verification, the record will show exit type as abandonment and not eligible for rehire if that is your policy. Report facts, not characterisation: dates of absence, notices sent, and the removal from rolls. Avoid the word "absconder" in written references; it invites defamation claims where the process was thin.
