A resignation letter is the employee's written notice of leaving, and the notice period clock starts the day it is submitted. In India the notice runs per the appointment letter, typically 30 days for junior roles and 60 to 90 days for senior ones, so the letter should state the computed last working day as an actual date, not a formula.
What a Resignation Letter Format must include
- Date of submission, because the notice period counts from this day
- Addressee: reporting manager, with HR in copy, as company policy requires
- A clear, unconditional statement of resignation from the named designation

- Compute the last working day yourself and write the date. If you resign on 10 August with 60 days notice, write "9 October" so there is no ambiguity in the F&F.
- Get an acknowledgement: a reply email or a signed copy of the letter. The acknowledgement date is your proof if the employer later claims a different notice start.
- If you change your mind, withdraw in writing before the resignation is accepted or takes effect. After acceptance, withdrawal needs the employer's consent.

Is a 30 day notice period legally mandatory in India?
No central law fixes one notice period for everyone. The appointment letter governs, and 30 days is simply the most common clause for junior and mid roles, with 60 to 90 days for senior ones. Some state Shops and Establishments Acts and Certified Standing Orders add their own notice rules, so check both the contract and the applicable Act.
Can I withdraw my resignation after submitting it?
Generally yes, before it is accepted or before the last working day, whichever the policy specifies. This is well settled for government service; in private employment the contract and HR policy decide. Put the withdrawal in writing and get a written confirmation, because after acceptance is communicated the employer can decline.
Can my employer refuse to accept my resignation?
No. Employment in India is contractual, not bonded, so an employer cannot force you to stay. What they can do is hold you to the notice period in the appointment letter, or recover notice pay for the shortfall if you leave early. Serve the notice or settle the buyout and the exit stands.
When should I receive my full and final settlement after resigning?
