Drafting tips

  • Never jump straight to the final letter. Two prior letters with 7 to 10 day gaps is the pattern tribunals look for; removal after a single notice is routinely overturned.
  • Send every letter by registered post and email, and file the proof. If a letter returns undelivered, keep the envelope unopened; it is your evidence of attempted service.
  • Use "removed from rolls" and "abandonment of service", not "terminated for misconduct". Misconduct termination needs a charge sheet and enquiry; abandonment does not, but the records must stay consistent everywhere, including BGV responses.
  • Settle the F&F even for an absconder. Earned salary and leave encashment stay payable, netted against notice pay and property recovery, and the Code on Wages 2 working day clock applies once the removal is processed. Withholding everything invites a wage claim.
  • Check the hospital angle before finalising. Genuine incapacity defeats an abandonment finding, so a hardship window in the final letter protects the company more than it protects the employee.

FAQs

After how many days of absence can we treat an employee as absconding?

No statute fixes a number. Most Indian HR policies trigger the first letter after 3 consecutive days of uninformed absence. Removal from rolls comes only after the full sequence runs, which in practice means 21 to 30 days from the first missed day. The day count matters less than the documented sequence of letters and windows.

Can we recover notice period pay from an absconding employee?

Yes, if the appointment letter provides for notice pay in lieu of notice. Net it against the employee's earned dues in the F&F: on a ₹40,000 gross salary with 30 days notice, that is a ₹40,000 recovery against salary and leave encashment payable. Filing a separate recovery suit for any balance is rarely worth the cost.

Is an absconding letter the same as a termination letter?

No. The absconding route treats the employee as having voluntarily abandoned the job, so the final letter records removal from rolls. A termination letter imposes dismissal for misconduct, which requires a show cause notice, charge sheet, and domestic enquiry first. Pick one route and keep every document, including the relieving communication, consistent with it.

What if all our letters come back undelivered?

That does not block the process. The law expects service at the last known address on record, so retain the unopened returned envelopes, the postal receipts, and the email delivery logs as proof of attempt. Add a call log with dates. Together these establish that the employee had every opportunity to respond.
