  • Compensation status: whether CTC in ₹ stays unchanged or is revised, plus any relocation allowance against bills
  • A line confirming carried-forward leave balance and unchanged seniority
  • An acceptance/acknowledgement block for the employee's signature and date, with authorised signatory sign-off

Drafting tips

  • Always state that continuous service and the original date of joining are protected. This is what stops a transfer from being read as a fresh appointment, which would reset gratuity and notice-period math.
  • If the new posting is in a different state, mention that Professional Tax and, where thresholds change, ESI will follow the new state's rules. PT slabs differ between Maharashtra, Karnataka, West Bengal, and others.
  • Keep the employee's UAN and PF account number identical across the transfer. Only the establishment mapping changes if the branch has a separate PF code; the UAN never does.
  • Get a signed acceptance copy back before the reporting date and file it. For a contested transfer, that acknowledgement is your first line of defence.
  • Give realistic notice and a clear handover deadline. A transfer order dated Monday that asks the person to report 900 km away on Wednesday invites a grievance.

FAQs

Can an employee legally refuse a transfer in India?

It depends on the appointment letter. If the original contract has a transferability clause (most do), a reasonable transfer within the same company is a lawful management instruction and refusal can be treated as misconduct. If there's no such clause, or the transfer materially cuts pay or is punitive, the employee has grounds to contest it. Draft the clause into the appointment letter first, and keep transfers non-mala fide.

Does a transfer break continuity of service for gratuity and PF?

No, as long as it's an internal transfer within the same legal entity and the letter says so. The employee's date of joining, continuous-service count for gratuity (payable after 5 years, calculated at 4.81% of Basic), and UAN all stay the same. Spell this out in the letter so there's no ambiguity later.

Is a salary change required in a transfer letter?

Not at all. Many transfers are lateral with identical CTC, and the letter should say the ₹ figure stays unchanged. If you are revising pay because of a location cost difference or a promotion tied to the move, attach a revised salary structure and state the new CTC and effective date clearly.
