Shops and Establishment Act

State-level law that regulates working hours, weekly off, leaves, and basic conditions for shops, offices, and commercial establishments. Registration is required within 30 days of opening.

What is Shops and Establishment Act?

Each Indian state has its own Shops and Establishment Act (e.g., Maharashtra 2017, Karnataka 1961, Delhi 1954). It governs commercial establishments, shops, offices, hotels, restaurants, and similar units. Standard rules cap daily work at 9 hours and weekly work at 48 hours, with overtime at twice the ordinary wage rate. The Act mandates one weekly holiday, paid annual leave (typically 15 to 21 days), sick leave, casual leave, and rules for women working in night shifts. Employers must register the establishment within 30 days of starting operations and renew the certificate per state rules. Display of working hours, weekly off, and the Act extract on the premises is mandatory. Penalties vary by state but commonly range from ₹1,000 to ₹1 lakh per violation.

Example

A SaaS startup in Bengaluru with 12 employees registers under the Karnataka S&E Act within 30 days, files annual returns, and grants 1 weekly off plus 18 paid leaves a year.

How Shops and Establishment Act is used

Register at incorporation, renew on time, and align attendance, leave, and overtime policies with the specific state Act applicable to each office location.
