What is Code on Wages, 2019?
The Code on Wages, 2019 consolidates 4 older laws into one framework that applies to all employees in both organised and unorganised sectors. Its standout feature is a uniform definition of wages: basic, DA, and retaining allowance, with a rule that excluded components (HRA, bonus, conveyance, etc.) cannot exceed 50% of total remuneration. If they do, the excess is added back to wages for PF, gratuity, and bonus. The central government notifies a national floor wage; no state minimum wage can fall below it. The Code introduces uniform timelines for wage payment (7th of next month for under 1,000 workers, 10th for larger units), equal pay for equal work across genders, and an inspector-cum-facilitator role replacing the old inspector raj. Rules are still being notified state-wise as of 2026.

Tech firm pays ₹40,000 CTC: ₹15,000 basic, ₹25,000 in HRA + special allowance. Since 25,000 > 50% of 40,000 (₹20,000), ₹5,000 is added to wages, raising PF and gratuity base.
