Surcharge on Income Tax
Surcharge is an extra tax charged on top of income tax for high earners. It kicks in at ₹50 lakh income and rises in steps. The new regime caps it at 25%; the old regime can still go up to 37%.
What is Surcharge on Income Tax?
Surcharge applies to the income tax amount, not the income itself. Slabs for FY 2025-26: 10% if total income is between ₹50 lakh and ₹1 crore; 15% between ₹1 crore and ₹2 crore; 25% above ₹2 crore (new regime) or above ₹2 crore but below ₹5 crore in old regime; 37% above ₹5 crore (old regime only). The Finance Act 2023 capped maximum surcharge at 25% under the new regime. So very high earners often save lakhs by switching to the new regime. There's also a marginal relief rule: if your income just crosses a slab and the extra tax (income tax + surcharge) is more than the income above the threshold, you only pay tax up to that excess. This prevents weird situations where earning ₹1 extra costs you lakhs in extra tax. Health and Education Cess of 4% is then applied on top of the income tax plus surcharge.
Example
Mahesh earns ₹1.2 crore taxable income under the new regime. Tax before surcharge (rough): around ₹31,12,500. Surcharge at 15%: ₹4,66,875. Cess at 4% on (tax + surcharge): around ₹1,43,175. Total tax: about ₹37,22,550.

Payroll engines compute surcharge month by month for high earners and adjust TDS. Marginal relief is applied automatically when income hovers around a threshold like ₹50 lakh or ₹1 crore.
